Is workers' compensation my only remedy after a Pennsylvania construction accident?

Workers' compensation is your exclusive remedy against your own employer — the exclusivity provision at 77 P.S. § 481 bars a negligence suit against the employer and, in most circumstances, against co-employees. It says nothing about anyone else. On a typical construction site the general contractor, the site owner, other subcontractors and their crews, equipment lessors, and product manufacturers are all separate legal entities. If one of them caused your injury, you can pursue a third-party negligence claim against them in addition to collecting comp benefits. That third-party case is where damages for pain and suffering, loss of life's pleasures, and full wage loss live, none of which workers' compensation pays.

What is the difference between a workers' comp claim and a third-party claim?

Workers' compensation is a no-fault system: you do not have to prove anyone was negligent, and it pays medical treatment and a portion of lost wages, generally two-thirds of the average weekly wage subject to the statewide maximum. It does not pay for pain and suffering, disfigurement in the tort sense, or the full value of a shortened career. A third-party claim is a fault-based negligence lawsuit against a company that is not your employer, and it can recover the full range of damages. What are the exceptions to the workers' compensation exclusivity rule?

The exclusivity bar in 77 P.S. § 481 is strong, but it is not absolute and it is narrower than employers suggest. Pennsylvania recognizes an intentional-injury line of cases where a genuine intent to injure — not gross negligence and not a knowing safety violation — takes conduct outside the Act. There is also the personal-animus or third-party-attack exception under 77 P.S. § 411(1) for assaults motivated by personal reasons rather than employment. Separately, a worker may be misclassified: if you were treated as an independent contractor, or if the entity you are suing is not actually your statutory employer, exclusivity may not apply at all. Determining who your employer actually was, on a site with layered subcontracts, is often the pivotal question.

Can I use an OSHA violation as evidence in my injury case?

Yes, as evidence — not as a standalone claim. The Occupational Safety and Health Act does not create a private right of action, so you cannot sue a contractor simply for violating it. What you can do is use the federal construction standards in 29 CFR Part 1926 to establish the recognized standard of care and to prove that the defendant knew what was required and did not do it. A citation, an inspection narrative, or an abatement record makes a jury question far more concrete. Admissibility is litigated in most cases, and courts handle it differently depending on whether the standard applies to the defendant and to the hazard that hurt you, so the citation is a starting point rather than a verdict.

When is the general contractor liable for my injuries?

When the general contractor retained and exercised control over the work or the site conditions that caused the harm. Pennsylvania generally follows the rule that a party hiring an independent contractor is not liable for that contractor's negligence, but the retained-control principle and the peculiar-risk doctrine are real exceptions, and the analysis is fact-driven. What matters is what the general actually did: whether it ran the safety program, controlled site access and sequencing, held toolbox talks, directed means and methods, controlled the fall-protection or excavation-protection plan, or had authority to stop unsafe work. The subcontract, the daily reports, the safety meeting sign-in sheets, and the superintendent's own testimony decide these cases far more than the label on the contract.

What are the most common serious construction injuries I see in Pennsylvania?

Falls from height dominate — from roofs, leading edges, unguarded openings, ladders, scaffolds, and aerial lifts — and they produce the most catastrophic outcomes: traumatic brain injuries, spinal cord injuries, and multiple orthopedic fractures. After falls, I see struck-by injuries from falling material and swinging loads, caught-in and crushing injuries from trench collapses and heavy equipment, and electrocution from overhead lines and unlocked circuits. Burns, amputations, and hearing and vision loss appear regularly. Each of these injury mechanisms maps to a specific set of federal standards and to a specific set of potentially responsible companies, which is why the mechanism drives the entire investigation.

Do I have to give up my workers' comp benefits if I bring a third-party claim?

No, but your employer's workers' compensation carrier has a subrogation interest in any third-party recovery under 77 P.S. § 671. In practical terms, the carrier is entitled to be reimbursed out of the third-party settlement for the benefits it paid, and it receives a credit against future benefits, with the cost of recovery — including a proportionate share of attorney fees — allocated under the statute and the case law applying it. This is not a reason to skip the third-party case. It is a reason to negotiate the lien deliberately and early, because the number that matters to you is what remains after the lien is resolved, and that number is negotiable far more often than injured workers are told.

What happens if I was partly at fault for the accident?

You can still recover. Pennsylvania applies modified comparative negligence under 42 Pa. C.S. § 7102: your damages are reduced by your percentage of fault and you are barred only if your share exceeds 50 percent. Construction defendants argue worker fault in nearly every case — that you failed to tie off, took a shortcut, or used the wrong ladder. The answer is usually contextual: whether fall protection was provided and usable, whether the schedule made the safe method impossible, and whether the site supervisor tolerated the practice every day until someone was hurt. Note also that a worker's fault does not affect eligibility for workers' compensation benefits, which are no-fault.

How long do I have to file a Pennsylvania construction accident claim?

Two clocks run at once. For workers' compensation, notify your employer as soon as possible — within 21 days to get benefits from the date of injury and no later than 120 days to preserve the claim at all under 77 P.S. § 631.1 — and a claim petition generally must be filed within three years. For the third-party negligence case, the deadline is two years from the date of injury under 42 Pa. C.S. § 5524. If a Commonwealth or municipal entity is involved, such as a PennDOT highway project, written notice must be given within six months under 42 Pa. C.S. § 5522. The practical deadline is much earlier, because equipment is repaired, sites are completed, and crews disperse within weeks.

I will not put a number on a case before the medicine and the liability record are developed, and I would be skeptical of anyone who does. What actually drives value is the permanency of the injury and whether surgery is required, the effect on earning capacity for a trade where the body is the tool, the strength of the liability proof against each non-employer defendant, the layered insurance available across the general contractor, subcontractors, owners, and equipment lessors, the fault allocation under § 7102, the venue, and the size of the workers' compensation lien.
